Election rules and the midterm vote

American elections are run by the fifty states, each with its own rules on who must show what, how ballots are cast and how districts are drawn. Since 2020 the two parties have fought over those rules in every legislature and court, because each believes the other is using them to win. Republicans say elections are too easy to cheat in; Democrats say Republicans make it harder for their voters to vote. The congressional elections of November 2026 are the next test.

The wider conflict and each side's full account: America's conflict over presidential power.

Where it stands · September 2026

The Supreme Court rejected the administration's restrictions on mail-in ballots for the midterms. Early voting began on 18 September. The Court blocked Missouri's Republican congressional map for the third time. The administration rolled back fuel standards as Republicans faced midterm pressure. The United States reportedly did not invite OSCE election observers for the midterms.

What the dispute is about

Who writes the rules. The constitution leaves elections to the states and lets Congress override them. It gives the president no role. The administration has tried to set rules by order, on proof of citizenship and on mail ballots, and the courts have mostly stopped it.

Security against access. Identity documents, proof of citizenship, shorter deadlines for mail ballots and purged voter lists make fraud harder and voting harder. How much of each is the argument, and there is no agreed measure of either.

The map. Most seats in Congress are decided by how districts are drawn. In 2025 Texas redrew its map at the president's request in the middle of the decade; California answered; other states followed.

How each side explains it

The Republican account

An election is only as good as the confidence of the loser. In 2020 officials and judges rewrote the rules for mail voting in the middle of a campaign, and tens of millions of ballots arrived with no check of identity. Every serious democracy asks voters to prove who they are; India does it for nine hundred million. Only citizens should vote, ballots should arrive by election day, and lists should not carry the dead. Those who resist such rules must have a reason.

The Democratic account

Fraud by voters is among the rarest of crimes, and every inquiry has confirmed it. The purpose of the new rules is to thin out the young, the poor and minorities, who less often hold a passport or a birth certificate in their current name. A president who tried to overturn one election is now firing election officials, claiming China stole 2020 and trying to set voting rules by decree weeks before a vote he expects to lose. The danger is not fraud but a result that is not accepted.

What each account leaves out

The Republican leaves out that reviews by Republican officials, in Georgia and elsewhere, found non-citizen voting in handfuls, not thousands; that the president himself has voted by mail; and that the mid-decade redrawing of districts began in Texas at his request.

The Democratic leaves out that large majorities of every group, Democrats and black voters included, support voter identification; that turnout rose in Georgia after the law they called suppression; and that they draw maps as ruthlessly where they govern, in Illinois, and since 2025 in California.

Both leave out that each has refused a result: many Democrats called the 2016 election illegitimate, and their candidate for governor of Georgia did not concede in 2018. Only one side's refusal ended with a crowd inside the Capitol.

The ledger

Republicans

Wanted: identification, proof of citizenship, fewer mail ballots, favourable maps.
Gained: new laws in most states they govern, a narrower Voting Rights Act, several seats by redrawing.
Paid: the national rules were stopped in court, and Democrats answered map for map.

Democrats

Wanted: national standards for access, which they could not pass when they held Congress.
Did: sued, and redrew their own states.
Gained: the mail ballot ruling.
Paid: the argument against partisan maps, which they can no longer make.

Voters

About a third of Americans tell pollsters they are not confident the vote will be counted fairly, and which third depends on who won last.
